1. Regulation of CDM Project Operation (Amended)

 Article 36 of Regulation of CDM Project Operation (Amended) (NDRC, MOST, MOFA & MOF Order No. 11), jointly promulgated by NDRC, Ministry of Science and Technology, Ministry of Foreign Affairs and Ministry of Finance on August 3, 2011:

 The income from transferring greenhouse gases emission reductions in the CDM projects shall be owned by the state and the project owners. Other entities or individuals shall not share the sum of the transactions of emission reductions. The distribution ratio between the state and the project owner is as follows:

(1)    HFCs projects: the state owns 65% of the turnover of the transfer of greenhouse gases emission reductions;

(2)    N20 projects in the production of adipic acid: the state owns 30% of the turnover of the transfer of greenhouse gases emission reductions;

(3)    N20 projects in the production of nitric acid and so on: the state owns 10% of the turnover of the transfer of greenhouse gases emission reductions;

(4)    PFCs projects: the state owns 5% of the turnover of the transfer of greenhouse gases emission reductions;

(5)    Other projects: the state owns 2% of the turnover of the transfer of greenhouse gases emission reductions.

 The income attributable to the state from the turnover of the transfer of greenhouse gases emission reductions in CDM projects will be collected by the Management Centre of CDM Fund in accordance with Regulation of China CDM Fund.

 2. Regulation of China CDM Fund

 The collection of the national revenue from transferring greenhouse gases emission reductions in CDM projects is explicitly provided for in Regulation of China CDM Fund (MOF et al. Order No.59), jointly promulgated by the Ministry of Finance, National Develoment and Reform Commission, Ministry of Foreign Affairs, Ministry of Science and Technology, Ministry of Environmental Protection, Ministry of Agriculture and China Meteorological Administration on September 14, 2010 with the approval of the State Council, is hereby promulgated and shall go into effect on the day of its promulgation.

 3. Methods for the Collection of National Revenue from Transferring Greenhouse Gases Emission Reductions in China CDM Projects

 In order to make the collection procedures of the national revenue clearer and more standardized, Ministry of Finance issued Methods for the Collection of National Revenue from Transferring Greenhouse Gases Emission Reductions in China CDM Projects (C.J. [2012] No.129) on November 20, 2012, further defining the calculation methods and payment process of the national revenue, as well as the punitive measures.
